TRADEMARK RENEWAL AND ASSIGNMENT PROCEDURES FROM JULY 1, 2026

From July 1, 2026, the procedures for certain industrial property rights related to trademarks in Vietnam will undergo significant changes according to Circular No. 20/2026/TT-BKHCN issued by the Minister of Science and Technology on May 20, 2026, effective from July 1, 2026.

Under the new regulations, the procedures for maintaining and renewing the validity of protection titles and the procedures for assigning trademark ownership have been restructured towards simplification and reduction of administrative procedures.

Notably:

  • The procedures for maintaining and renewing the validity of protection titles are consolidated under Article 108; Article 109 of Circular No. 10/2026/TT-BKHCN is repealed.

  • The procedure for registering industrial property assignment contracts is no longer carried out as an independent procedure. Trademark assignment is integrated into the procedure for amending protection titles under Article 110 of Circular No. 10/2026/TT-BKHCN, as amended and supplemented by Circular No. 20/2026/TT-BKHCN.

  • Some forms, dossier components, and procedural methods are also adjusted according to the new regulations.

Below is detailed guidance on trademark renewal and assignment procedures applicable from July 1, 2026.

I. TRADEMARK REGISTRATION CERTIFICATE RENEWAL PROCEDURE

1. Protection Term and Trademark Renewal Period

A trademark registration certificate is valid throughout the territory of Vietnam from the date of issuance and lasts for 10 years from the date of valid application filing.

The trademark owner has the right to request multiple consecutive renewals. Each renewal extends the validity for an additional 10 years, for all or part of the protected goods and services.

According to regulations, the renewal request dossier must be submitted within 06 months before the expiration date of the Trademark Registration Certificate.

If the dossier is submitted after the aforementioned deadline, the Intellectual Property Office of Vietnam (IPVN) may still accept and process the renewal request if the dossier is submitted within 06 months from the expiration date of the protection title. In this case, the title holder must pay an additional late renewal fee, corresponding to 10% of the renewal fee for each month of late submission.

Note: The owner should proactively carry out the renewal procedure before the expiration date to avoid incurring additional costs and to mitigate the risk of affecting trademark rights.

2. Trademark Renewal Dossier

The renewal request dossier can be prepared in paper form or submitted online through the National Public Service Portal.

The dossier components include:

1. Declaration for maintenance, renewal of industrial property protection title validity

Use Form No. 01 in Appendix II issued with Circular No. 20/2026/TT-BKHCN.

This declaration form replaces the previous form under the new regulations.

2. Original Trademark Registration Certificate

Only applicable if the title was issued in paper form and the title holder requests the renewal to be recorded directly on the original title.

3. Power of Attorney

Required if the owner carries out the procedure through an industrial property representative service organization.

4. Proof of fee and charge payment

Submit a copy of the payment receipt or document proving completion of fee and charge obligations as regulated.

3. Trademark Renewal Dossier Processing Procedure

After receiving the dossier, the IPVN will examine and process the renewal request.

Examination period: 01 month from the date the IPVN receives a complete and valid dossier.

If the dossier meets the requirements, the IPVN will issue a Notice of Renewal of Protection Title Validity, record the information in the National Register of Industrial Property, and publish it in the Industrial Property Official Gazette within 30 days from the date of the notice.

If the dossier is not valid, the IPVN will issue a Notice of Intent to Refuse Renewal of Validity, stating the reasons and setting a deadline of 02 months for the applicant to remedy deficiencies or submit objections.

If the applicant fails to remedy the deficiencies to satisfaction or does not provide appropriate objections within the deadline, the IPVN will issue a Decision to Refuse Maintenance, Renewal of Protection Title Validity.

4. Trademark Renewal Fees and Charges in 2026

According to the provided document, from July 1, 2025, to December 31, 2026, some fees are reduced by 50% according to Circular No. 64/2025/TT-BTC to support businesses. Fees belonging to the fee group are still collected at the regulated rates.

Actual fees and charges may depend on the number of goods/services classes and the specific dossier status.
